PPT Charges Arising from CFSEU/North Cowichan RCMP Joint Project Crown Stayed Mid-Trial

In 2021 the RCMP Combined Forces Special Enforcement Unit (CFSEU) and the North Cowichan RCMP launched a joint project, investigating what they believed to be a drug trafficking operation, run out of an apartment complex in Duncan, BC. Throughout this investigation, police executed multiple search warrants, and our client and two other individuals were charged with a number of drug trafficking offences. The search warrants were based, in part, on information received from confidential informers. On behalf of our client, we filed a comprehensive Charter notice challenging the validity of the search warrants, the manner of search, and the grounds for our client’s arrest. During the course of the search warrant voir dire, it became clear that there were material discrepancies between the CI information and the information the affiant included in the search warrant. The trial was adjourned so the Crown could provide further disclosure. Shortly after that adjournment, Crown directed a stay of proceedings against all accused.

Outcome: Stay of Proceedings. All charges dropped mid-trial.
