Passenger of Vehicle Acquitted on PPT Charges

The client was a passenger and one of three occupants of a vehicle stopped by police for a Motor Vehicle Act infraction. The client was charged with Two Counts of Possession for the Purposes of Trafficking in methamphetamine and fentanyl, as well as three counts of simple possession. At trial, the issue was the knowledge and control of the drugs, which were not in plain sight but within arms reach of some or all of the vehicle passengers. Ultimately, the trial judge held that without more, the Crown had not proven possession beyond a reasonable doubt. The client was acquitted of all charges.
