Acquittal on All PPT Charges

The client was the owner and driver of a motor vehicle containing one passenger. Both occupants of the vehicle were charged with two counts of possession for the purposes of trafficking. The drugs in question were located in a backpack in the client’s vehicle. At trial, Waugh & Associates successfully argued that the Crown had failed to tender a certificate of analysis in relation to one of the charges. As a result, the Crown was unable to prove the nature of the substance. The Crown ultimately abandoned the prosecution on the count partway through the trial. The trial continued on the remaining charge. Waugh & Associates successfully argued that the client did not have knowledge or control of the drugs located in the backpack found in her vehicle. At the conclusion of the trial, the client was acquitted of all charges.

Outcome: Client Acquitted. No Criminal Record.
